In these Terms of Use, these companies are collectively referred to as Primend.
Primend websites are primarily informational and are intended to provide information about Primend companies, services, solutions, expertise and other matters related to Primend's business activities.
The websites may also enable users to contact Primend, submit enquiries, download materials, access support functionality and use other digital features made available through the websites.
Primend's IT services are not generally purchased through the websites, and use of the websites or submission of an enquiry does not in itself constitute the conclusion of a service agreement with Primend.
2. Use of the websites
Primend websites may only be used for lawful purposes and in a manner that does not adversely affect the rights, interests, systems or security of Primend, other users or third parties.
Users must not:
- disrupt or impair the operation of the websites, servers, networks or other information systems;
- attempt to gain unauthorised access to the websites, administration systems, user accounts or other Primend systems;
- attempt to circumvent security or access controls;
- distribute malware, malicious code or other unlawful content through the websites;
- use the websites for fraud, identity misuse or other unlawful activities;
- collect data from the websites by automated means in a manner or to an extent that infringes Primend's or third parties' rights or applicable law;
- use website content in a misleading or unlawful manner;
- use Primend's intellectual property without the appropriate rights or authorisation.
Primend may restrict access to a website or particular functionality where this is necessary to ensure security, stop unlawful activity or protect the rights of Primend or third parties.
3. Login and submission of support requests
Primend websites provide access to a login environment through which users may, among other things, submit and manage support requests addressed to Primend User Support.
The login functionality is not intended for the general storage of customer data or overall administration of the customer relationship, except to the extent necessary for handling the relevant support request.
Users are responsible for maintaining the confidentiality and security of their login credentials and must not permit use of their account by persons who are not authorised to do so.
When submitting a support request, users are responsible for ensuring that:
- the information provided is accurate and relevant to the support request;
- no more personal data or confidential information is included than is necessary to resolve the relevant issue;
- the user has the right to provide Primend with the information contained in the support request.
If a user suspects that login credentials have been compromised or that the account has been used without authorisation, Primend should be notified as soon as possible.
Primend may restrict or temporarily suspend access to the login environment where there are reasonable grounds to suspect misuse of an account or another security risk.
In addition to these Terms of Use, support services may be subject to service terms, service levels or other contractual terms agreed separately between Primend and the relevant customer.
The processing of personal data in connection with support requests is governed by the Primend Privacy Policy and, where applicable, the relevant contractual arrangements between Primend and the customer.
4. Information published on the websites
Primend makes reasonable efforts to ensure that information published on its websites is accurate, up to date and understandable.
General information concerning services, solutions, technologies, prices or other terms is provided for informational purposes unless expressly stated otherwise.
Information published on the websites does not in itself constitute a binding offer or contractual commitment by Primend.
Primend may amend, correct or update information published on its websites.
For a specific customer relationship, the agreement, proposal, order and other terms agreed between Primend and the customer apply. If general website information differs from the terms agreed with a particular customer, the terms agreed between the parties prevail in relation to that customer relationship.
5. Contact forms and enquiries
Primend websites may allow users to contact Primend, submit enquiries or request information about Primend services.
Users are responsible for ensuring that information submitted to Primend is accurate and that they have the right to provide such information.
Submitting a contact form, enquiry or request for a proposal does not automatically result in the conclusion of a contract with Primend.
The processing of personal data in connection with contact forms and enquiries is described in the Primend Privacy Policy.
6. Downloadable materials
Primend websites may provide articles, guides, reports, presentations, videos, webinar materials and other downloadable or viewable materials.
Unless otherwise stated in relation to a particular material, materials created by Primend may be used for personal or internal organisational informational purposes.
Without Primend's prior permission, Primend materials may not be:
- resold or otherwise distributed for commercial purposes;
- published or presented as the user's own work;
- reproduced with references to the author, Primend, trademarks or copyright notices removed;
- modified in a manner that distorts their original meaning or creates a misleading impression of Primend's position;
- used in a manner that infringes Primend's or a third party's intellectual property rights.
When referring to Primend material, a clear reference to Primend as the source must be retained where Primend is the author or rights holder.
Materials belonging to third parties are subject to the terms and rights of the relevant rights holder.
7. Intellectual property
The structure and design of Primend websites, texts, graphics, photographs, videos and other materials created by Primend, as well as the Primend name, logo and other Primend trademarks, are owned by Primend or used under an appropriate licence.
Use of the websites does not transfer to the user any ownership or other intellectual property rights in relation to the websites or their content.
The websites may also display trademarks, logos, product names and other materials belonging to third parties.
For example, Microsoft's name, logo, product names and other Microsoft trademarks remain the property of Microsoft or the respective rights holders. Their display on a Primend website does not give users any right to use them.
The same principle applies to trademarks and materials belonging to other Primend partners and third parties.
8. Links to third-party websites
Primend websites may contain links to third-party websites, services and platforms, including those of technology partners, business partners and social media providers.
Third-party websites and services are operated by the relevant third parties and may be subject to their own terms of use, privacy policies and cookie policies.
Primend does not control third-party website content and is not responsible for the availability, security, content or data processing practices of such websites, except to the extent that liability arises under applicable law.
The inclusion of a link on a Primend website does not in itself mean that Primend assumes responsibility for or endorses all content available on the linked website.
9. Website availability
Primend aims to ensure reliable operation and availability of its websites and their core functionality.
Primend cannot, however, guarantee uninterrupted or entirely error-free operation of the websites.
Website availability may be affected by, for example:
- maintenance and development activities;
- technical failures;
- interruptions to communications, hosting or cloud services;
- cybersecurity measures;
- interruptions to third-party services beyond Primend's control.
Primend may modify, supplement, temporarily suspend or restrict a website, its content or functionality where necessary for development, maintenance, security or other legitimate operational reasons.
10. Liability
Primend makes reasonable efforts to ensure that information published on its websites is accurate and up to date. General information published on the websites should not, however, be regarded as individual professional advice provided for a particular user's circumstances.
Articles, guides, overviews and other materials published on the websites are primarily informational and do not replace IT, cybersecurity, legal or other professional advice based on the circumstances of a particular organisation.
Primend is not responsible for loss or damage resulting from:
- the user's own acts or omissions;
- use of the website contrary to these Terms of Use or applicable law;
- use of third-party websites, platforms or services;
- technical failures or interruptions beyond Primend's reasonable control,
except where Primend's liability arises under applicable law and cannot lawfully be excluded or limited.
Nothing in these Terms of Use excludes or limits Primend's liability to the extent that such exclusion or limitation is prohibited by applicable law.
11. Personal data and cookies
Primend may process personal data when users access and use its websites.
The purposes and legal bases of processing, retention of personal data, recipients of personal data, international transfers and data subject rights are described in the Primend Privacy Policy.
The use of cookies and similar technologies on Primend websites and users' options for managing cookie preferences are described in the Primend Cookie Policy.
12. Applicable law and dispute resolution
The use of Primend websites is subject to applicable European Union law and, where relevant to the particular legal relationship, the law of the country in which the relevant Primend Group company is established.
Where a dispute arises in connection with the use of a Primend website, the parties will seek to resolve the matter through negotiations in the first instance.
If an agreement cannot be reached, the dispute will be resolved in accordance with the applicable law and rules of jurisdiction.
These Terms of Use do not restrict any rights that cannot be waived or limited by agreement under applicable law.
13. Changes to these Terms of Use
Primend may update these Terms of Use where there are changes to website functionality, Primend's business activities, technical solutions or applicable legal requirements.
The current version of the Terms of Use will be published on the Primend website.
Where appropriate, Primend may provide additional notice of material changes.

For questions concerning Primend websites or these Terms of Use, please contact Primend using the contact details published on the relevant Primend website.
